6. HOW YOU AND WE ENTER INTO THE CONTRACT
6.1 After submitting an order, you will receive an email confirming receipt of your reservation. This does not indicate that your reservation has been approved. Your booking is an offer to purchase services from us. All appointments are subject to our acceptance, which we will affirm by sending you an email confirming your reservation (Booking Confirmation). The Contract (Contract) between us will not be formed until we send you the Booking Confirmation.
6.2 Only those services whose booking we have confirmed in the Booking Confirmation will be linked to the Contract. We are not obligated to provide any additional services that may have been part of your order until their booking has been confirmed in a separate Booking Confirmation.
7. CUSTOMER RIGHTS & CANCELLATION
7.1If you are a consumer, you may terminate your Contract for services at any time prior to the expiration of the cancellation period, which is seven (7) working days after the date our Contract with you was formed.
7.2 If your transaction is terminated in accordance with clause

The provision of services is always contingent on the availability of engineers, therefore: 7.5.1 We will make every effort to notify you as soon as possible if we are unable to deliver the services you have ordered within the specified timeframe due to unforeseen circumstances. Insofar as it relates to services we are unable to provide, our agreement with you will be deemed null and void.
8. AVAILABILITY AND DELIVERY
8.1 Your order will be fulfilled on the booking date set out in the Booking Confirmation or unless there are exceptional circumstances at a mutually agreed alternative date.
8.2 The services will be delivered to you at the address you provided in your booking request.
9. FAILURE TO PROVIDE ACCESS
9.1If delivery of services ordered by you was unsuccessful due to your failure to provide access to the property as per your order, we reserve the right to charge you a £40 including VAT no-access fee.
10. PRICE AND PAYMENT
10.1 Unless an apparent error occurs, the price of the services will remain the same after the confirmation email has been sent, unless an obvious error has occurred. Our total repair cost includes diagnostic and labour, but does not include the cost of replacement parts, which will be billed separately.
10.2 Services prices exclude VAT. Nevertheless, if the VAT rate changes between the date of your order and the date of delivery, we will alter the VAT you pay unless you have already paid in full for the services before the change in VAT takes effect. Prices and delivery fees for services are subject to change at any time, but changes will not affect orders for which you have already received a Booking Confirmation. If we order your parts from a third-party supplier, we will bill you for the shipping costs. 10.4 Our website features multiple services, so it is always feasible that. Normally, as part of our booking confirmation procedures, we will verify prices so that, if the actual cost of the service is less than our specified price, you will be charged the lower amount. In contrast, presume the actual price of the service is higher than the price listed on our website. Then, at our discretion, we will either contact you for further instructions before confirming your reservation, or we will reject your order and notify you that we are doing so.
If the pricing error is apparent and unmistakable and could have been recognised by you as an error, we are under no obligation to provide you with the services at the incorrect (reduced) price. 10.6 All services must be paid for with a credit card, debit card, or cash. 11. APPLIANCE REPAIRS
11.1. Our one-time fixed charge covers the cost of the service engineer's call out, diagnostics, and labour, regardless of how long the engineer is on-site or how many times he must return to solve the problem. The focus of the restoration is determined by the description of the assigned responsibility. We intend to repair the majority of household appliances. Nevertheless, the appliance's manufacturer, type, model, and age will significantly impact our ability to quickly procure replacement parts and ultimately complete the repair. Additionally, once a specific appliance is discontinued, the manufacturer will only stock replacement parts for a limited time. 11.3. We require payment in cash or by debit/credit card on the initial visit of the technician. Our technician will arrive on the agreed-upon date and time to repair your appliance. If any necessary parts are unavailable at the time of the service contact, our service engineer will typically order them within one to two business days. The item(s) will then be delivered to us within two business days after the order has been placed. If the part(s) are not in stock, this can take up to three business days, with the average being approximately ten business days. It should be noted that, sadly, there are a few manufacturers whose parts are difficult to obtain. In some instances, these must be obtained from abroad, causing a delay in the completion of the repair. As soon as the part(s) become available, we will contact you to schedule a new repair appointment. We repair residential appliances installed in commercial locations. In such cases, we do not provide a warranty for these repairs. Regarding refrigeration equipment, we do not provide coverage for food deterioration or loss. If you request that we repair more than one of your appliances on your property, we will charge you the standard repair rate for any additional work that you and we agree upon.
12. ISSUES THAT MAY ARISE DURING YOUR REPAIR
12.1. If, at the time of the call out, it is determined that the fault was caused by misuse, neglect, or poor installation, or if the appliance's make, model, or brand is not as described, we reserve the right to charge you the full labour rate applicable to the brand. In the event that we are unable to obtain replacement parts from our suppliers in order to repair your appliance, we reserve the right not to do so. In such cases, we will only charge the diagnostic / administration fee of £50 (excluding VAT). If your appliance cannot be accessed readily for repair, we reserve the right to cancel the service. In such cases, we reserve the right to charge you a £50 non-VAT indemnity fee. When cancelling maintenance, you are expected to give as much notice as feasible. If we have already arrived at your location and the repair is in progress, you will be charged for the repair (diagnosis and labour included) if you cancel at that point. You must provide safe and sufficient access for the installation and removal of all products. Although we will take precautions to install or remove appliances without causing damage to flooring or adjacent fixtures, we cannot be held liable for such damage unless it was caused by our negligence. We will attempt to notify you if we believe insufficient access is available, and if you do not wish to run the risk of damaging the surrounding area, you may terminate the Contract.
13. WARRANTY
13.1 Both labour and materials are guaranteed for six months on all London Appliance Services. This warranty does not cover subsequent, unrelated appliance breakdowns or defects. It is also rendered invalid if the appliance is relocated to a new location.
14. OUR LIABILITY
14.1 Subject to clause 14.3, our utmost aggregate liability to you for losses or damages suffered is limited to the purchase price of the services. 14.2 With the exception of clause 14.3, we are not responsible for the following losses: 14.2.1 loss of income or revenue; 14.2.2 loss of business; 14.2.3 loss of profits; 14.2.4 loss of anticipated savings; 14.2.5 loss of data; and 14.2.6 management or office time waste. This clause 14.2 does not, however, preclude claims for loss or damage to your property that is reasonably foreseeable or other claims for direct loss that are not excluded by the categories in this clause. 14.3 Nothing in this contract limits or excludes our liability for: 14.3.1 death or personal injury resulting from our negligence; 14.3.2 Fraud or fraudulent misrepresentation; 14.3.3 Any breach of the obligations implied by section 2 of the Supply of Goods and Services Act 1982; 14.3.4 Defective goods under the Consumer Protection Act 1987; 14.3.5 any other matter for which it is unlawful to exclude or attempt to exclude our liability.
15. WRITTEN COMMUNICATIONS
15.1 Some of the information or communications we send to you must be in writing per applicable law. By using our website, you consent to primarily electronic communication. We will provide you with information via email or by posting notices on our website. You consent to this electronic mode of communication for the objectives of the agreement. You agree that all contracts, notices, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. This condition has no effect on your legal privileges.
16. TRANSFER OF RIGHTS AND OBLIGATIONS
16.1 The agreement between you and us is enforceable against you, us, and each of our respective successors and assignees. 16.2 You cannot, without our prior written agreement, transfer, assign, charge, or otherwise dispose of a Contract or any of your rights or obligations arising under it. 16.3 During the duration of the Contract, we are free to transfer, assign, charge, subcontract, or otherwise dispose of the Contract or any of our rights or obligations resulting therefrom.
18. WAIVER
18.1 If, at any time during the term of a Contract, we fail to insist upon strict observance of any of your obligations under the Contract or any of these terms and conditions, or if we fail to exercise any rights or remedies to which we are entitled under the Contract, this will not be construed as a waiver of those rights or remedies and will not release you from such obligations. 18.2 Our concession of one default does not imply that we will also waive any subsequent defaults. 18.3 Unless it is explicitly declared to be a waiver and is disclosed to you in writing in accordance with paragraph 14 above, no waiver by us of any of these terms and conditions will be valid.
19. SEVERABILITY
19.1 If a court or other competent authority rules that any provision of these terms and conditions or any provision of a contract is invalid, illegal, or otherwise unenforceable in whole or in part, that provision will only be severed to the extent that it is so determined, and the remaining provisions will remain in effect to the fullest extent permitted by law.
20. ENTIRE AGREEMENT
20.1 With regard to the subject matter of any Contract, we intend to rely on these terms and conditions and any document expressly referred to in them.
